Terms & Conditions
By creating an account, accessing or otherwise using the Platform, you agree to be bound by these Terms and by our Privacy Policy and Refund Policy. If you do not agree, you must not use the Platform.
1. Definitions
- “User” means any person who accesses the Platform, including job seekers and employers.
- “Seeker” means a User who uses the Platform to look for employment.
- “Employer” means a User who uses the Platform to post jobs or search for candidates.
- “Services” means all features made available through the Platform, including voice recording, transcription, matching, application tracking and messaging.
- “Content” means any data, text, voice recording, transcript, image, listing, or other material submitted to or generated through the Platform.
- “Applicable Laws” means all laws, rules, regulations, notifications and circulars in force in India.
2. Eligibility
You may use the Platform only if you:
- are at least eighteen (18) years of age;
- are an Indian resident or otherwise legally permitted to use the Platform;
- are competent to enter into a binding contract under the Indian Contract Act, 1872;
- have not been previously suspended or removed by Bolo.
You agree not to impersonate any person or entity, or misrepresent your identity, age, affiliation or qualifications.
3. Account & Profile
To use most features, you must register an account using your mobile phone number and complete one-time-password verification. You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us immediately of any unauthorised access. You agree to provide accurate, current and complete information and to keep it updated.
4. Services
The Platform offers a voice-first job-search experience: Seekers record short voice introductions and Employers record short voice job descriptions. Bolo transcribes these recordings, extracts relevant attributes, and surfaces matches between Seekers and Employers. Bolo is a technology platform; we do not employ, supervise or guarantee any Seeker, Employer, job, salary or hiring outcome. All hiring decisions and employment relationships are between the Seeker and the Employer.
5. User Content & Licence
You retain ownership of Content you submit. By submitting Content, you grant Bolo a non-exclusive, worldwide, royalty-free, sub-licensable licence to host, store, copy, transcribe, translate, adapt, display and otherwise process the Content for the purposes of operating, providing and improving the Platform, including training and evaluating our AI/ML systems. You represent and warrant that you have the right to submit such Content and that it does not infringe the rights of any third party.
6. Prohibited Conduct
You agree not to, and not to permit any third party to:
- impersonate any person or misrepresent your identity, employer or qualifications;
- post fake, misleading, fraudulent, deceptive or paid-for-fake job listings or profiles;
- solicit money, deposits, fees, commissions, gift cards or any other payment from any other User in exchange for a job offer or job application;
- upload obscene, defamatory, harassing, hateful, discriminatory or unlawful Content;
- infringe any intellectual property, privacy, publicity, contractual or other right;
- distribute spam, viruses, malware, or any other harmful code;
- scrape, crawl, mirror or otherwise access the Platform by automated means without our prior written consent;
- circumvent any security or rate-limiting feature of the Platform;
- use the Platform in violation of any Applicable Law;
- use the Platform to send unsolicited commercial communication;
- resell, sub-licence or commercially exploit access to the Platform without our prior written consent.
We reserve the right to remove Content and to suspend or terminate accounts that violate these Terms.
7. Verification
We may, but are not obliged to, verify the identity, eligibility or claims of any User. We do not guarantee the accuracy, completeness or truthfulness of any User-submitted information, including resumes, voice intros, job descriptions, salary figures or company details. Users should conduct their own due diligence before acting on any listing or application.
8. Fees & Subscriptions
Most Services on the Platform are offered free of cost. Bolo may, from time to time, offer paid features, plans or subscriptions. The pricing and scope of such features will be displayed before purchase. All payments are processed through third-party payment gateways (such as Razorpay) and are subject to their terms. Refunds are governed by our Refund Policy.
9. Intellectual Property
The Platform, including its software, design, trademarks, logos, content (other than User Content) and all related intellectual-property rights, is owned by or licensed to Bolo. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your personal, non-commercial use, subject to these Terms. All rights not expressly granted are reserved.
10. Disclaimers
The Platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Bolo disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement and accuracy. Bolo does not warrant that the Platform will be uninterrupted, error-free, or secure, or that any particular job, candidate or hiring outcome will be achieved.
11. Limitation of Liability
To the maximum extent permitted by law, Bolo’s aggregate liability for any and all claims arising out of or relating to these Terms or the Platform, whether in contract, tort or otherwise, shall not exceed INR 1,000 (Rupees One Thousand only). In no event will Bolo be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, business or goodwill, even if advised of the possibility of such damages.
12. Indemnity
You agree to defend, indemnify and hold harmless Bolo, its affiliates, directors, officers, employees and agents from and against all claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or relating to (a) your use of the Platform; (b) your Content; (c) your violation of these Terms or Applicable Laws; or (d) your violation of any third-party right.
13. Suspension & Termination
We may suspend or terminate your access to the Platform at any time, with or without notice, if we reasonably believe you have breached these Terms or any Applicable Law, or if continued access poses a risk to Bolo, other Users or any third party. You may delete your account at any time from your profile. Upon termination, the provisions that by their nature should survive (including Sections 5, 9, 10, 11, 12, 14, 15 and 16) will survive.
14. Modifications
We may amend these Terms from time to time. The “Last updated” date above indicates when they were last revised. Material changes will be communicated through the Platform or by email. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Subject to the next sentence, the courts at Delhi, India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Platform. Any dispute that the parties agree to refer to arbitration shall be finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator mutually appointed by the parties. The seat and venue of arbitration shall be Delhi, India, and the language of arbitration shall be English.
16. Miscellaneous
- Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- Waiver. A failure to enforce any provision shall not constitute a waiver of that or any other provision.
- Force majeure. Bolo shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms to any affiliate or successor without notice.
- Entire agreement. These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Bolo concerning the Platform.
- Language. The English version of these Terms is the controlling version; any translation is provided for convenience.
